Personal Injury in Wyoming
Wyoming law follows a system of modified comparative negligence, or the 51% rule, whereby an injured party can recover damages only if it is determined that his or her fault in causing the injury does not reach 51%. If the injured party was 50% or less at fault, he or she may still recover damages. However, if a plaintiff’s fault reaches 51%, he or she cannot recover anything. In other words, a plaintiff may have caused half of the accident and still recover damages from the court, but if it is found that the plaintiff’s fault was more than half, that plaintiff is barred from receiving any damages as determined by the court.
Furthermore, under Wyoming law, a plaintiff’s recovery is reduced by the degree of his or her fault. For example, if it is determined that a plaintiff is responsible for 25% of an accident, any damage award would be reduced by that portion of the fault. If the plaintiff suffered $10,000 in damages, that award would be reduced by 25%, or an award of $7,500.

Under Wyoming law, a personal injury claim must be filed within four years of the date of the injury. If you have a wrongful death claim, the stature of limitations to file is only two years.
